  Ms M Garrett v Lidl Limited UKEAT/0541/09

 

In this case, it was concluded that a move to a different store could amount to a reasonable adjustment. The Employment Appeal Tribunal also considered harassment which, in relation to disability, occurs when the disabled person is subjected to unwanted conduct that has the purpose or effect of violating their dignity or of creating an intimidating, hostile, degrading, humiliating or offensive environment.  It was determined that, when considering harassment, it is important to consider the effect on the alleged victim irrespective of the motive or the person or persons responsible for the harassment.
